Consumer Action is assisting Tanya, a mother of five, in a legal action against Chalavon Proprietary Limited trading as Lion Car Rentals (ACN 149 985 188). Lion Car Rentals is involved in ‘rent-to-buy’ car deals.
Tanya alleges that she entered into an expensive, two year ‘rent-to-buy’ car deal with Lion Car Rentals, who unlawfully repossessed the car approximately a year later.
Consumer Action Law Centre has filed a proceeding in the Federal Circuit Court on behalf of Tanya against Lion Car Rentals.
Tanya alleges that:
- the contract was in effect a sale of goods by instalments , regulated by the National Credit Code;
- Lion Car Rentals did not hold an Australian credit licence and had engaged in unlicensed credit activity;
- the contract was unjust; and
- Lion Car Rentals engaged in unconscionable conduct.
Lion Car Rentals deny these allegations. The case is listed for hearing on 27 February 2019 in the Federal Circuit Court.
